Take the Mystery out of Underwriting Title to Railroad Lands
Everybody loves the railroad, except when it comes to title to railroad lands. Why is that? For at least several reasons. First, because the law related to and history of railroads in the United States is vast and intricate. There are thousands of cases dealing with railroad lands. And every state has statutes too. Second, because railroad lands are unique in that the railroad needs absolute control over the right of way, but often they do not hold fee simple in it. Thus, what looks like fee simple by conduct, often isn’t. And third, it is often difficult to obtain the information you need to determine what they got because of mergers, lost records and ancient deeds that are often difficult to read. In this Engagement Lab, Bill will facilitate a discussion to help participants recognize that there may be a need to look further when a railroad right of way is referenced the search, the legal description, or a railroad is shown on a drawing such as a survey or tax map of the Land. We are going to look at the big picture and create framework to solve any railroad mystery.
